Analysis and evaluation of Iran's criminal policy for crimes of insult and intimidation in cyberspace
In recent years, with the expansion of the Internet in the country, public access to cyberspace has greatly expanded to cover all cities and many villages in the country; But cyberspace, due to its breadth and availability, the ignorance of the perpetrator of the crime, its high speed, the existence of unfamiliar victim syndicates and the lack of adequate supervision in this regard, has provided the ground for committing many crimes. This study examines the crimes of "threat" and "insult" in cyberspace and analyzes Iran's criminal policy on these crimes. The results of the investigation, after reviewing the laws, regulations and judicial procedure, show that the existing enforcement guarantees do not have sufficient deterrent capability and do not have the capacity to cover the relevant crimes; As a result, given the growing prevalence of cybercrime and the need for coordinated action by criminal lawmakers in this regard, we need to develop existing laws and new criminalization. The main focus of this article will be the analysis and critique of Iran's criminal policy against the crimes of "insult" and "threat" in cyberspace.
