The Positive Basis of Warning for the Establishment of Civil Liability for Persons (Iranian and International Law)
Among the rules used in jurisprudence and law are \"the rule of warning or warning\", whereby every person must warn others before and after committing dangerous and fatal operations that, if necessary, civil and criminal liability arises. Exempt, and otherwise, shall have civil and criminal liability (Excuse me). The rule of war also has jurisprudential backing, with its sources being the 6 books, the tradition, the fame, and the building of rationality, the most important of which is rationality. Among the principles discussed in the affidavit of loss liability can be the termination of the customary citation relationship as the basis for warning (loss agent) irresponsibility. The proportionality of the hazard warning, the legality and validity of the warning action, the precedence of the hazard warning, the ability to understand and leave the hazard, constitute the conditions of the warning rule; Be fundamental. Therefore, in this research we have considered the alert rule as a circumstance that can prove the proof of legal responsibility of individuals and around it we have examined the relevant domestic and international laws in a descriptive-analytical manner and the authors believe that the alert rule is rooted in customary principles. And can serve as a positive basis for civil liability.
