The principle of Neglecting Al-Asr and Adapting It to the Exchange of Goods and Currencies

Abstract:

The rule of neglecting or rejecting Asr Haraj is one of the common rules of jurisprudence that is applicable to various jurisprudential abuses including worship and transactions. For the sake of validity and validity, the evidence has been based on the rule. The point of this rule is that every hard and painful thing in Islam is rejected. But there is disagreement among jurists as to whether negation is a prohibition, a negation of a work, or whether it is a rule of secular law. The investigations show that, first, the meaning of the haraj is the negation of the injunction; And fourthly, this rule applies to assignments as well as assignments. One of the issues that is causing havoc for Muslims and the Islamic community is the issue of smuggling of commodities and currencies as they cripple the economy and increase unemployment and reduce domestic production. In this research, we try to explain the legitimacy of the trafficking phenomenon and to derive its jurisprudential ruling after proving the validity of the rule and the scope of this rule.
